  1. Introduction.

Thank you very much for using Staycations Kenya ! Your trust is vital to us and we are committed to protecting your data’s privacy and protection. The information we share helps us make an excellent experience of Staycations Kenya . We have a dedicated privacy team that ensures that all personal data we receive is secured and that sensitive information is processed correctly all over the world.

In conjunction with your access and use of the Staycations Kenya  Platform and the Payment services, this Privacy Policy describes how we collect, use, process, and disclose your personal information. Our privacy policy describes all websites, platforms and services that relate to our privacy practices. Read the relevant website privacy policy.

1.1 Definitions

If the term is undefined (e.g. “Booking” or “Staycations Kenya  Platform”) in this Privacy Policy, it has the same definition as that in our terms of service (“Terms”).

1.2 Receiver of Information

This policy mentions the entity that is responsible for your details under this Privacy Policy (the data controller) and refers to the company of Staycations Kenya , “we,” “us” or “our” as mentioned above.

  • If Kenya is your country of residence, or outside Kenya, the Staycations Kenya  Data Control is protected and in compliance with The Data Protection Act of 2019, Laws of Kenya.

1.3 Transaction compliance applicability

The Payment Services made available for Staycations Kenya  Payments in compliance with Payment Terms of Service (“payment terms”) are also protected by this privacy policy. You will also provide your information, including your personal data, to one or more Staycations Kenya  Payments entities using the payment services, that is to say the data controller of your payment data, generally is dependent on your country of residence, in relation to the Payment Services.

  • Whether you are living in Kenya or in a country outside Kenya, Staycations Kenya  Payments is the Payment Data Controller.

  1. Information Gathering

The knowledge that we obtain is in three general categories.

2.1 You provide us with details.

2.1.1 Information required for Staycations Kenya  Platform use.

When you use the Staycations Kenya  Platform, we ask and collect the following personal information about you. This information is necessary to ensure the proper performance of the contract between you and us and to enable us to comply with our legal obligations. Without it, we may not be in a position to provide you with all the services requested.

  • Information on the account. When you sign up for the Staycations Kenya  Account, we require certain information, such as your first name, last name, e-mail address and date of birth.
  • Information on the profile and listing. To use certain features of the Staycations Kenya  Platform (such as booking or listing), we may ask you to provide additional information, which may include your address, phone number, and a profile image.
  • Information on identity verification. To help create and maintain a trusted environment, we may collect identity verification information (such as images of your government issued ID, passport, national ID card, or driving license as permitted by applicable legislation) or other authentication information. See our Help Center article on providing Staycations Kenya  Identification for more information.
  • Information on payment. In order to use certain features of the Staycations Kenya  Platform (such as booking or listing), we may require you to provide certain financial information (such as your bank account or credit card information) in order to facilitate payment processing (via Staycations Kenya  Payments).

2.1.2 Information that you choose to give us.

You may choose to provide us with additional personal information in order to gain a better user experience when using the Staycations Kenya  Platform. This additional information will be processed on the basis of our legitimate interest or, where applicable, your consent.

  • Additional information on the profile. You may choose to provide additional information as part of your Staycations Kenya  profile (e.g. gender, preferred language(s), city, and personal description). Some of this information, as shown in your Account settings, is part of your public profile page and will be publicly visible to others.
  • Contact information for the Address Book. You may choose to import your contact address book or enter your contact information manually to access certain features of the Staycations Kenya  Platform, such as inviting them to use Staycations Kenya .
  • Other information, please. Otherwise, you may choose to provide us with information by filling out a form, updating or adding information to your Staycations Kenya  Account, responding to surveys, posting to community forums, participating in promotions, communicating with our Customer Care Team, sharing your experience with us (such as through Host Stories) or using other features of the Staycations Kenya  Platform.

 

2.1.3 Information necessary for the use of Payment Services.

The Payments Data Controller must collect the following information necessary for the proper performance of the contract with you and to comply with applicable law (such as anti-money laundering regulations). You will not be able to use Payment Services without it:

  • Information on payment. When using Payment Services, the Payment Data Controller requires certain financial information (such as your bank account or credit card information) in order to process payments and comply with applicable law.
  • Verification of identification and additional details. If you are a Host, the Payment Data Controller may require identity verification information (such as images of your government issued ID, passport, national ID card or driving license) or other authentication information, your date of birth, your address, e-mail address , phone number and other information to verify your identity, provide the Payment Services to you and comply with your payment requirements.

2.1.4 Information We automatically collect from Your interaction with Staycations Kenya  Platform and Payment Services.

When you use the Staycations Kenya  Platform and Payment Services, we automatically collect personal information about the services that you use and how you use them. This information is necessary for the proper performance of the contract between you and us, in order to enable us to comply with legal obligations and in view of our legitimate interest in being able to provide and improve the functionality of the Staycations Kenya  Platform and Payment Services.

  • Information on geo-location. If you use certain features of the Staycations Kenya  Platform, we may collect information about your exact or approximate location as determined by data such as your IP address or your mobile device’s GPS to provide you with an improved user experience. Most mobile devices allow you to control or disable the use of location services for applications in the device settings menu. Staycations Kenya  may also collect this information even if you do not use the app if this connection is enabled by your device settings or permissions.
  • The use of information. We collect information about your interactions with the Staycations Kenya  Platform, such as the pages or content you view, your searches for listings, your bookings, and other actions on the Staycations Kenya  Platform.
  • Data logging and information on the device. We automatically collect log data and device information when you access and use the Staycations Kenya  Platform, even if you have not created or logged in to the Staycations Kenya  Account. This information includes, but is not limited to: details of how you used the Staycations Kenya  Platform (including when you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and pages that you viewed or engaged with before or after using the Staycations Kenya  Platform.
  • Similar technologies and cookies. We use cookies and other similar technologies when you use our platform, use our mobile app, or engage in online ads or email communications. Some information may be collected by automated means using technologies such as cookies, web beacons, pixels, browser analysis tools, server logs, and mobile identifiers. In many cases, the information we collect using cookies and other tools is only used for non-identifiable purposes without reference to personal information. For example, we may use the information we collect to better understand the patterns of traffic on the website and to optimize our experience on the website. In some cases, we link the information we collect using cookies and other technology to your personal information. Our business partners can also use these tracking technologies on the Staycations Kenya  Platform or engage others to track your behavior on our behalf.
  • SDKs and pixels. Third parties, including Facebook, may use cookies, web beacons and other storage technologies to collect or receive information from our websites and elsewhere on the Internet and to use that information to provide measurement services and target ads. For apps, third parties, including Facebook, may collect or receive information from your app and other apps and use that information to provide measurement services and targeted ads. Users can opt out of collecting and using ad targeting information by updating their Facebook account settings and by contacting opt-out@maskanihomes.com with a description of your request and validation information.   • Do Not Monitor signals. The Staycations Kenya  platform currently does not respond to the “Not Monitor” signal on your browser or mobile application in HTTP header because it does not provide standardization about how this message should be interpreted, even though you may disable the use of cookies in your browser settings.
  • Information on payment transactions. Staycations Kenya  Payment collects your payment operations data, including the instrument used for the payment, date and time, payment number, the date and the postcode of payment instrument, PayPal email, IBAN, address, and other relevant transaction information through the Staycations Kenya  Platform (MHP). This information is important for the appropriate fulfillment and the provision of payment services between Staycations Kenya  and you.

2.1.5 Information collected from third parties. information.

Payments that collect, and combine with information that we collect from the Staycations Kenya  and payment services, information, including information about you, provided by others when they use the Staycations Kenya  Platform, or obtain information from other sources. We do not monitor, manage, or respond to the manner in which third parties provide your personal data, and any requests for information concerning the release of your personal data have to be made to third parties.

  • Support for third parties. The third party service may give us information such as your registration, friends list, and profile information from the service if you link, connect or login to a third party service (for example Google , Facebook, and Instagram) on your Staycations Kenya  account. This information is controlled and controlled by or authorized by that service via your confidentiality settings.
  • Your references. You can agree to publish a reference on your Staycations Kenya  Public Profile page if anyone writes a reference for you. See our post on connections in the Aid Centre.
  • Information on the background. Members in Kenya that receive reports from public records of convictions of a criminal offender or sex offender registers to the extent permitted by laws applicable to Staycations Kenya  and Staycations Kenya  Payments. Staycations Kenya  and Staycations Kenya  Payments may, where required, have a local version of police, background and registered sexual offender checks, to the extent permitted by applicable legislation and with your consent. We can use your information to collect these records, including your full name and date of birth.
  • Invites and account management for corporate goods. Organizations that use our company products (such as Staycations Kenya  for work and property managers and owners) should apply personally identifiable information in order to facilitate account management and to invite businesses to use the products.
  • The person invited you can provide your personal information, such as an e-mail address or any other contact information, if you are invited to Staycations Kenya .
  • Other sources. We may receive additional information about you from third-party service providers and / or partners, such as demographic data or information to assist in identifying fraud and security concerns, and may combine this information with the information we possess about you, if permitted by applicable law. For example, we could receive background checks (if required with your permission) or service providers’ warnings of fraud such as identity checks and risk assessment. In partnership, or with our partner ad networks, we can obtain information about you and your activities on and off our Staycations Kenya  Platform.

2.2 Data for Children.

Our websites and applications are not targeted at children under the age of 16 and we do not obtain personal information from children under the age of 16. If you are of the opinion that we are inappropriately handling your personal details about a child, we take this very seriously and encourage you to contact us using the information given in the “Contact Us” section below.

  1. How we implement information we collect?

Our personal information may be used, stored and processed in (1) the Staycations Kenya  Platform may be used, understand, improved and developed; (2) trusted and more secure environments (as they are in compliance with our legal obligations and the Staycations Kenya  Policy) may be created, stored and managed; and (3) our publicity and marketing can be improved, personalized and improved.

3.1 The Maskani Home Platform should be created, enhanced and built.

In order to provide, enhance and grow the Staycations Kenya  Platform we will use personal information such as:

  • allow you Staycations Kenya  Platform to connect and use,
  • allow you to contact other leaders, •
  • running, securing, enhancing, and optimizing the Staycations Kenya  Project, such as performing analysis and research.
  • Give client support, •
  • Send texts, changes and security warnings and confirmation of account to your service or support;
  • We the process this information if you provide us with your contact information:

 

  1. to facilitate your invitations for referral;
  2. to forward your requests for references;
  • to detect and prevent fraud; and
  1. for any purposes that you approve during collection;

 

  • We carry out a host guarantee claims, host protection warranty, experience security insurance or other similar host protection programs based on your experiences with Staycations Kenya  platform and experience to run, secure, enhance and streamline, customize and personalize your experience (sometimes listing suggestions, rating search results) and provide profiles based on you
  • make your use of the products of our business.

For these reasons, in view of our legitimate concern to enhance the Staycations Kenya  Platform and the experience of our Members and where appropriate to fulfill the contract with us, we process this personal information.

3.2 Creating and maintaining an environment of trust and protection

In order to create a trustworthy and safe environment, we may use personal information for:

  • detection and prevention of fraud, spamming, harassment, safety incidents and other damaging activities;
  • conduct health analysis and risk evaluations;
  • Check the details you have given or authenticate your identifications (e.g. to check or compare your accommodation address with the one you have received),
  • Conduct inspections of databases and other sources of information, including history or police investigations, in accordance with applicable law and, if possible, with your consent.
  • our legal obligations are met,
  • Settle disputes and execute our deals with third parties with one of our members;
  • Enforcing our Service Standards and other policies

We can perform profiling on the basis of your contact with the Staycations Kenya  Platform, profile information and other contents submitted by you to the Staycations Kenya  Platform, and information obtained from third parties in relation to the above activities.

In limited situations, the access to the Staycations Kenya  Platform may be restricted by automated processes if such activities are identified which we consider may present protection or any other danger may our Staycations Kenya  Platform, our communities or third parties. Please contact us in the contact us section below if you challenge the decision based on the automated process.

For this reason, given our legitimate interest in protecting the Staycations Kenya  Site, to assess our contract with you adequately and to comply with the relevant laws, we shall process this personal information.

3.3 Have our ads and promotions, personalize, calculate, and improve.

In order to provide, personalize, calculate and enhance our publicizing and marketing products, we can use our personal information:

  • to give you promotions, commercialization, ads, and other information that may concern you based on your preferred preferences and social media advertisement through social media platforms such as Facebook or Google (including information about Staycations Kenya  or Partner campaigns or services))
  • Customizing, calculating and enhancing our advertising,
  • Manage reference programs, incentives, surveys, sweepstakes, contests and other promotional activities or events that Staycations Kenya  or its third-party partners sponsors or manage,
  • perform profiling on your characteristics and interests to send you promotional communications, promotions, advertisement and other information which we think may be of interest for you, based on information you provide us, your contact with the home portal in Staycations Kenya , information gathered by third parties and your search and reservation records.
  • The frequency of administrative mails we can send to any Staycations Kenya  Account does not alter by registering for an e-mail subscription. There is no charge to send promotional e-mails to you, but data rates can apply to third parties. Remember that, without a Staycations Kenya  account, you might not be able to benefit from such promotions and
  • invite you to events and relevant opportunities (for example, we will use the details given to invite you for similar events to share your host story).

Despite our legitimate interest in marketing activities, we must process your personal information for the purposes specified in this section in order to give you goods or services of interest.

3.4 How the Controller uses the collected personal information.

As part of payment services, we can use personal details such as:

  • Allow you to use the payment systems and to use them.
  • Identification and prevention of fraud, mistreatment, defense, etc.
  • Perform health analysis and risk assessments.
  • Perform database searches and other sources of information.
  • Compliance with legal standards (such as anti-money laundering rules).
  • Enforce the terms of payment and other rules on payment.
  • Send promotional letters, ads, advertisement, and other details which may be of interest to you, according to your preferences, with your consent.

Due to its legitimate interest in enhancing payment infrastructure and the experience of its customers, the Payments Data Controller collects this data for the purposes of the effective execution of the contract to comply with applicable law.

3.5 Kenya SMS Conditions.

In the case of text messaging in Kenya, you agree to receive one or more text messages (“opting in”) by requesting, entering, agreeing to, signing in, signing up to, accepting or otherwise consenting to receive or use the Staycations Kenya  agreement whereby Staycations Kenya  may submit or receive one or more text messages (“text message service”), you acknowledge such SMS Terre’s. Message rates and data rates may be appropriate.

Staycations Kenya  must make fair commercial efforts to supply automated text messages to the amount that they supply from compatible wireless companies. Carriers and Staycations Kenya  are not liable for communications delayed or not sent. Not all Kenya carriers are able to accept the short code used in certain text messaging services.

Opting In

By choosing a message service for text:

  • You expressly allow Staycations Kenya  to send text messages with an opt-in cell phone number (i.e. the numbers listed on an opt-in formula or the instructions, or if none, the number of the opt-in, or, if not, the file number on your account, to use Auto-dialer or non-auto-dialer technologies).
  • You also require Staycations Kenya  in these messages to provide marketing information. You may not opt in or agree to opt-in as a purchasing condition.
  • You consent to use an online log to support your Opt-In data. Please contact us using the methods listed in the Contact Us section to revoke your consent, request a free paper or email-copy of the opt-in, or update our records with your contact information. You need;

 

  1. a system (such as computer or mobile telephone) with Internet access and
  2. a printer or storage room on this system to display and maintain an electronic copy of these SMS terms or the remainder of your opt-in.

 

So those characteristics of our service could not be available to you if you withdraw your consent.

 

Please check your Notification settings in your account settings to update details about how we can electronically notify you.

 

  • You accept that you are the subscriber of the telephone number or are the recipient of the family or business plan number, and that you have the permission to opt-in.
  • You consent to use an online log to support your Opt-In data. Please visit your Staycations Kenya  account Notifications settings or contact customer service to revoke your consent and update our records with your contact details.
  • Such SMS terms will only apply if the aforementioned permission is revoked or the text message service has been discontinued.

Upon choosing In, you can receive one or more welcome messages or administrative messages in addition to the key messages on the service page, such as a request (in some instances) to confirm your opt-in.

About the text and performance messages

Message rates and data rates may be appropriate. Text Message Services send multiple repeated messages unless otherwise specified. Staycations Kenya  shall, at any time, with or without prior warning, terminate any or all of the messages which you will otherwise receive with the Text Messaging Service, including for example, but these SMS Terms will still apply. STOP any promotional message or change your “Notification” settings on your Staycations Kenya  account if appropriate.

In response to a marketing message or contact customer support for extra assistance, Text Assistance.

3.6 The choices you made

The promo messages you chose to get are your preference.

  • The details you give to Staycations Kenya  can be limited. Promotions and marketing services operate on a voluntary basis.
  • The communications sent to you by Staycations Kenya  can be minimal. To opt-out, just click the connection called “unsubscribe” at the bottom of the marketing email we send or access your Staycations Kenya  account notification settings.
  • In response to any post, text STOP will revoke permissions you might have granted to send promotional text messages.
  • You can also change the notification settings inside your Staycations Kenya  Account through your Staycations Kenya  Account Notifications section. Please note that we still will have to contact you with essential transactional details on your account, even though you opt out of Marketing Communications. For example, we can still send you activity or fraud warnings, even if you opt out of e-mails.
  1. Disclosure & Exchange

4.1 Social Media and Advertising; Share with Your Agreement.

Once you have given your consent we will share your information, including your personal information, as defined in the Consent, for instance once permitting third-party requests or websites, or participating in promotions conducted by the partners or third parties of the Staycations Kenya  Account.

Where law permits, we may use restricted personal information on yourself, such as your email address, for hatching and sharing with social media sites, including Facebook or Google, for the generation of leads, the transmission of information to our website or otherwise for promotion of our products , services or the Home Page in Staycations Kenya . Such procurement practices are focused on our genuine involvement in the selling of goods or services that you might be interested in.

Staycations Kenya  will not monitor or supervise the social media sites with which we can communicate your personal information. Any concerns about the way your provider handles your personal information on your social media account should therefore be addressed to that provider.

Please notice that, by sending an e-mail to opt-out@maskanihomes.com, you can at any moment request Staycations Kenya  to stop processing your data for these purposes.

4.2 Members Sharing

To facilitate Bookings or other interactions between Members, we may need, as is required to carry out the contract between us and you, to share certain information, including personal information, with other Members:

  • When you make the reservation request as a guest, all details on you will be shared, including your profile, complete name, the full name of the guests, your cancelation history and any information that you agree to share. Once your reservation is confirmed, additional information, such as your telephone number, will be disclosed to support your tour coordination.
  • If a booking has been verified (or if applicable), certain details (and other guests can, if necessary) be exchanged with the Guest, such as your profile, full name, telephone number and Accommodation or Experience address, is given to the Guests. The booking is to be arranged. •
  • When you as a host invite another Member to become a Co-Host, you authorize a Co-Host, including, but not restricted, such details such as your full name , phone number, accommodation address, schedule, details listing, photo listing and e-mail address, to have access and retain the information and the content of a Member.
  • If you invite additional guests to make your reservation as a guest, each additional guest will be provided with your full name, travel dates, Host name, listing details, Accommodation address and other related information.
  • If you are a guest, the request for payment group will be shared among all participants of the Group Payment Booking Request for certain information regarding each participant, including a first name, last initial, picture and reservations.

We do not share with other Members your billing and payment details.

4.3 Profiles, Lists and Other Information to the Public

The Staycations Kenya  Portal allows you to publish information that is available to the general public, including personal information. Examples include:

  • Your public profile page is publicly visible to others, like your first name, your description, and the town.
  • The pages on the listing are publicly available and provide details such as accommodation or the approximate location of the experience (neighborhood and town) or a particular location (where you have consented); the listing summary, the calendar availability, your image in the public profile (like the views of the page over a period of time).
  • Guests and hosts will write reviews and rate each other after completing a reservation. Reviews and reviews are part of your public profile page and can also be viewed elsewhere (for example on the listing page) on Staycations Kenya  Platform.
  • When you present content on the Staycations Kenya  website in the community or forum, blog, or social media, the material is accessible to the public.

Thanks to the legitimate desire to promote the Staycations Kenya  platform, we will view parts of the Staycations Kenya  platform (e.g. the listing page) using technologies such as widgets or APIs on sites run by Staycations Kenya ‘ business partners. When you view your listings on a partner ‘s website, details can also be seen from your public profile page.

You may search engines by third party indexing information you share publicly on the Staycations Kenya  Platform. In certain instances, in the settings of your account, you can opt out of this feature. Such search engines cannot update their databases if you change your settings or your publicly-facing content. We do not monitor search engine practices by third parties, and which use caches which contain your outdated information.

4.4 Hosts Supplementary Services

Hosting providers may need services from third parties accessible via the Staycations Kenya  network, for example cleaning services or locking providers, to manage their accommodation or provide additional services needed by you. The hosts may use the functions on Staycations Kenya  Platform for the purposes of arranging their stay, managing the accommodation or providing other services to share information about the guest (such as check-in and check-out dates, guest name or guest telephone number) with these third-party providers. Hosts are responsible for the third-party service providers they use, who guarantee their safe processing of the guest information, including data security and data privacy regulations, in accordance with relevant legislation.

4.5 Law Enforcement, Legal Request Response, Damage Prevention and Protection

Payments may disclose, where required or permitted under law or when such disclosure is reasonably necessary: (i) in order to comply with our legal obligations;

(ii) in order to comply with a valid legal application; Staycations Kenya  and Staycations Kenya  Payments may disclose to the courts, law enforcement, tax authorities or authorized third parties, including any personal information; Host tax information, for example, can be exchanged between tax authorities or other government entities if it is allowed because of the forgoing circumstances.

Such disclosures may be necessary to comply with our legal obligations in respect of the protection of your or another person’s fundamental interest in maintaining, preventing, implementing or protecting the law, facilitating tax collection and preventing tax fraud or preventing damages for the purposes of our or a third party ‘s legitimate interest in maintaining the Staycations Kenya  Platform secure.

Where appropriate, we may notify MPs concerning legal applications except; (i) the notice of the notification is prohibited by the legal process itself, by the order of the tribunal issued to us, or by the law applicable, or

(ii) the notification is considered to be ineffective, to establish or increase the risk of injury or bodily harm to an person or group; When, for these purposes, we must comply with legal demands without warning, we will seek to inform the Member after the evidence, when possible, and we can in good conscience agree that this is no longer prohibited.

 

4.6 Providers of Service

Staycations Kenya  and Maskani Payments uses a range of service providers from third parties to help us provide the Staycations Kenya  Platform and Payment Processing services. Within or outside of Kenya, service providers can be based.

For example, service providers may help us:

  1. verify your identity, or authenticate your identification documents,
  2. check information against public databases,
  • conduct back gathering or police checks, prevention of fraud and risk assessment,
  1. perform product creation, maintenance, and debugging;

These service providers have limited access to your personal information in order to carry out these tasks on our behalf and are contracted to protect personal data and to use personal data in accordance with our directives only.

In order to guarantee the adequate performance of our contract with you, Staycations Kenya  and the Staycations Kenya  Payments will need to share your details, including personal information.

4.7 Corporate Membership

We can share your information or personal information with our company family of companies (both financial as well as non-financial entities) connected by common ownership or control to allow or help you in the provision of the Staycations Kenya  Platform and Payment Services.

  • Staycations Kenya  sharing. Even though your country of residence is not Kenya, your details may also be shared with Staycations Kenya , Inc. that provides Staycations Kenya  Platform’s technological infrastructure, product creation and maintenance, customer care, trust and security services to others. The knowledge exchange between you and us is required in order to execute the contract and is based on our legal interests in the global provision of the Staycations Kenya  Project.
  • Exchange payments with Staycations Kenya  Families. Such information as mentioned above in the section “information required for the use of the payment services” above may be shared with the Staycations Kenya  Payments entity in order to ease payments on or by means of a Staycations Kenya  Platform. For the implementation of the contract between you and us, data sharing is important.

However, to help, incorporate, promote, and improve the Staycations Kenya  Platform and our affiliate’s services, we share your information, including personal information with our companies.

4.8 Occupancy Tax Collection and Remission

Where Staycations Kenya  allows the collection and transfer of occupancy charges easier as defined in the ‘Fiscals’ section of the Terms of Service, Hosts and Guests, where legally permissible by applicable laws, it explicitly grants us, without notice, authorizing the disclosure or transaction of Hosts’ and Guests’ data and details, Ac

4.9 Registration of the Government

We may exchange, with the relevant authorities, information from the participating hosts during the application process and, if applicable, periodically after the application process such as t, in jurisdictions in which Staycations Kenya  allows or needs the registration, notification, permit or licensing of a host with the local authority by means of the Staycations Kenya  Platform in compliance with local law.

4.10 Corporate Customer Details

If you have linked your Staycations Kenya  account to the Staycations Kenya  house accounts of a company or other organization (an “Enterprise”), you have added your work e-mail address, or you have made a booking by someone other than a business (such as a potential employer or another entity).

4.11 Host information for work clients given to Staycations Kenya

If the reservation is made for business and is made by a business affiliate guest and the company is registered for our workplaces in Staycations Kenya , for example for business reservations with a coupon provided by a company, we may disclose information related to the reservation to the company , for example, the name of the host, the address of the accommodation, the date of reservation, etc. We may share the information with third parties engaged in providing travel management, travel planning, financial reporting, personnel management , crisis management or other services at the request of the company or the Guest.

4.12 Guest information for working clients provided by Staycations Kenya

When you have connected your Staycations Kenya  account to a company and are includes in a business reservation, we may reveal the company’s booking details to the extent required to ensure that the Staycations Kenya ‘ agreement with the company is carried out adequately. This usually includes booking information including your name, booking dates, number of guests, location, listing details, lodging address and other information related to this. Upon request by you or your company this information may also be reported to service providers involved, such as travel management agencies, financial reports, personal management, and crisis management firms. This information may also be revealed. Staycations Kenya  can also share additional relevant details that it considers appropriate for the situation to be secure and rapid to resolve in the event of a contentious, emergency, or similar situation involving a booking established for company.

4.13 Managers and owners’ services

For the facilitation of programs with these partners, we may share personal data and reservation information with property landlords, management companies and/or property owners. For example, booking guests and personal information must be communicated to house, complex or planned community owners and property managers, where host resides, and/or the listing may facilitate the provision of hosting facilities, security, billing, and other facilities.

4.14 Transfers of business

If Staycations Kenya  undertakes, or is participating in, all or part of our assets, including your information regarding, in relation to or contemplating a particular transaction, including the merger, acquisition, reorganization, sale of assets, bankruptcy or insolvency, we may then sell, transfer or divide our assets. Throughout this situation, we will alert you before moving your personal information and implementing a new privacy policy.

4.15 Data obtained

Aggregated information (information on our users, which we aggregate so that an individual user does not know or reference any longer) and other anonymized information on regulatory enforcement, industry and market analysis, research, demographic profiling, marketing, advertisement and other business purposes can also be exchanged.

5.1 The correspondence research

The Staycations Kenya  Platform helps us to monitor, track and analyze your communications for fraud detection, risk analysis, regulatory enforcement, research, product creation, data, analytics, and customer service. We search and review messages to cover up contact details and connections to other websites for example as part of our fraud prevention efforts. For certain cases, messages for debugging may also be copied, updated, or modified, changed, or extended. Where appropriate, we use automated methods. They sometimes need, however, to analyze and enhance the functionality of these automated systems or to manually inspect certain communications such as fraud investigations and customer assistance. We do not scan, evaluate, or archive your messages to give you Marketing Messages from third parties and we do not offer feedback or analyzes of such messages.

This activity is based on the legitimate interest of Staycations Kenya  to ensure that applicable legislation and our terms are complied with, avoids fraud, promotes security, and enhances and ensures that our services operate adequately.

5.2 Connecting the accounts of third parties

You can use a third-party Social Networking service to connect your Staycations Kenya  account to your account. Developing such links:

  • you can publish some details on your Staycations Kenya  account profile from a link to your accounts.
  • you can show your activities on the home platform to your friends on the home platform or on the third-party site; • Your activities on the Staycations Kenya  platform;
  • a link to your public profile may be included in your Staycations Kenya  public profile on that third-party social networking service;
  • Other users of Staycations Kenya  can see any mutual friends you have with them, or how, if appropriate, you are a friend of their friend;
  • other Staycations Kenya  users can see any schools, hometowns, or groups you share in your social networking service;
  • the data you provide us from the linkage of your account for fraud prevention and risk assessment purposes can be stored, processed, and transmitted; and
  • Your setting and permits for publication and display of information you provide to Staycations Kenya  on the Staycations Kenya  Platform and third-party platform are subject to this relation.

We obtain only information from related third-party accounts to the degree necessary to ensure proper execution or compliance with applicable laws or your approval to our contract with you.

5.3 Partners and integrations with third parties

Staycations Kenya  Platform may include links to websites or services of third parties, such as integrations of a third party, co-branded services or branded third party services (“Third Party Partners”). Staycations Kenya  does not own or manage these third-party partners and you may provide information directly to the third party, Staycations Kenya , or both, when you communicate with them. These third-party partners may have their own guidelines on information collection, usage, and disclosure. The privacy policy of the other web pages you access are recommended to check.

Part of the Staycations Kenya  Project can use services from third parties, such as Google Maps / Earth and Citibank Payments, for Google Maps API(s). The use of these respective services shall be governed by their privacy policies such as Google Maps, the Google Privacy policy Citi Privacy Policy and Earth Additional Terms of Use.

In compliance with applicable law, before your applicable Home Data Controller and Payments Data Controller you are entitled to exercise all of the rights mentioned in this section. See here for information on requests for data subject rights and how to file a query. Please note that before taking further action on your request, we may ask you to verify your identity and ask.

6.1 The data processing

You can use your account settings to access and update some of your details. You can change your Preferences and revoke your permission for the application by modifying your account settings if you have chosen to connect your Staycations Kenya  Account to a third-party application, such as Facebook or Google. You are responsible for updating your personal details.

6.2 Incorrect or incomplete information correction

You may ask us to correct your personal details incorrect or incomplete (which you cannot change inside your Staycations Kenya  account).

6.3 Access to and portability of information

Some jurisdictions may have the right to request such copies of your personal data kept by us under applicable law. You also have a right to request a structured, usually used, and machine-readable copy of your personal information and/or to ask us to forward it to another service provider (where technically feasible).

6.4 Retaining and eradicating data

In general, we maintain your personal details as long as this is required to satisfy our legal obligations and satisfy the contract between you and us. You may order all of your personal information to be completely deleted in a certain jurisdiction. “Please note that if you apply for your personal information to be erased:

  • We will retain some of your information as required for our legitimate business interests like fraud detection and security and safety upgrades. We will retain some details from Staycations Kenya  Account in order to prevent it from opening a new Staycations Kenya  Account in the future if we terminate the Account for fraud or security purposes.
  • To the degree required to satisfy our legal obligations, we will keep and use your personal information. For example, Staycations Kenya  and Staycations Kenya  Payments will preserve some of the tax and legal reporting information as well as the auditing requirements.
  • The information you have exchanged with other persons (i.e. feedback, updates on the forum) that continue to be available to the public on our Staycations Kenya  Platform, even though your Staycations Kenya  account is terminated. Furthermore, you will also be removed from your assignment of these information.
  • We maintain the Homes Maskani Network to ensure that your information does not get backups of your personal information from our backup systems for a limited period of time, in order to protect yourself from accidental or malicious loss and destruction.

6.5 Cancelation of Consent and Transmission Limit

You may at any time withdraw your consent if we process your personal data on the basis of your consent, changing settings of your account or sending a letter to Staycations Kenya  specifying what consent you are withdrawing. Please notice that the withdrawal of your consent does not impact, prior to withdrawal of such consent, the validity of any processing activities. Furthermore, in some jurisdictions, the applicable law could grant you the right to restrict the way we use your personal information, especially when;

  1. you dispute the accuracy of your personal information.
  2. your treatment is unlawful and that you object to the erasure of personal information from you;

6.6 Processing objection

Under certain jurisdictions, the relevant law may allow the Commission to require Staycations Kenya  and Staycations Kenya  Payments not to process your personal details for any particular purposes (including profiling). Staycations Kenya  and/or Staycations Kenya  Payments will no longer process your personal details for such purposes, unless it is clear that the state, exercise or protection for such processing needs valid legal reasons for such processing or such care.

6.7 Complaints for accommodation

You have the right, by lodging a complaint with our data protection officer who can be contacted by “contact Us” below or by a supervisory authority, to make complaints about our data handling activities.

  1. Information Security

In order to protect your information from unauthorized access, failure, destruction and modification, we constantly monitor and enforce administrative, technological and physical security measures. Firewalls and data encryption and access controls are some of the safeguards we are using to protect your data. Please feel free to contact us following the instructions in the contact us section below if you have any reason to suspect that credentials for the Staycations Kenya  account are lost, stolen, misappropriated, or otherwise affected, or if you have any real or suspected unauthorized use of your Staycations Kenya  Account.

  1. The Privation Police Changes

In compliance with this clause Staycations Kenya  reserves the right to change this Privacy Policy at any time. When the Privacy Policy is changed, the revised Privacy Policy will be posted on the Staycations Kenya  Page and the last update date at the top of the Privacy Policy will be updated. At least thirty (30) days before the date on which the change is made, we will also inform you by email. You can cancel your account if you do not agree to the revised Privacy Policy. Unless you do not terminate your account prior to the date on which the revised Privacy Policy comes into effect, the revised Privacy Policy refers to your continued access to or use of the Homes Portal.
